Whisk - Terms of Use

These Terms of Use ("Terms") govern access to the Whisk mobile application, trywhisk.app, and associated services (collectively, the "Services") provided by the operator of Whisk ("Whisk," "we," "us," or "our"). By accepting these Terms or using the Services where such use constitutes valid acceptance, you agree to these Terms. If you do not agree, you must discontinue use.

Our Privacy Policy explains the processing of personal information. Acceptance of these Terms is not consent to optional data processing that requires separate permission.

You must be at least 13 years old and meet any higher minimum age applicable in your jurisdiction. If you have not reached the age of legal majority, you may use the Services only with the permission and supervision of a parent or legal guardian who may lawfully accept these Terms on your behalf.

Account registration supports email and password or Apple Sign-In. You must provide accurate information, maintain the confidentiality of your credentials, and promptly report suspected unauthorized access. You are responsible for your use of the account, subject to applicable law; these Terms do not make you responsible for losses attributable to our breach of a legal obligation.

Whisk provides a pre-generated recipe catalog and recommendations informed by available preferences. Free accounts may access the designated free collection. An active Whisk Pro subscription or eligible trial provides access to the full catalog and recipe customization, subject to the offer presented at purchase.

You may save recipes, organize them into cookbook boards, and add saved recipes to a weekly meal plan. Selected servings are used when adding meal-plan ingredients to a grocery list. Grocery entries may be linked to a source recipe; removing that recipe from the grocery list removes its associated items. You may also add custom grocery items.

The Services assist with planning and list preparation. They do not purchase groceries or guarantee ingredient availability, pricing, quantities, or nutritional suitability. Review serving adjustments, grocery quantities, and cooking instructions before use.

Customization is a Pro feature that modifies a catalog recipe in response to your instructions. The result may replace the recipe currently displayed. Automated validation and correction do not constitute human review or a guarantee that a result is accurate or suitable.

Each successful customization is stored privately for your account. It appears in the cookbook only upon an explicit save action. Unsaved drafts remain stored without automatic expiration until account deletion as described in the Privacy Policy. Unsaving a recipe removes its cookbook reference but does not delete the stored customization or revert its saved status. Privacy from other users does not prevent processing by Whisk and its providers as described in the Privacy Policy.

AI-generated or modified content may contain inaccurate ingredients, quantities, allergens, nutrition estimates, preparation steps, or unsafe substitutions. Results may be similar to those generated for others. Whisk does not guarantee uniqueness, copyright protection, or exclusive rights in AI output.

Whisk Pro is offered through auto-renewing monthly or annual subscriptions. The purchase screen and Apple confirmation identify the price, billing period, applicable trial, and other offer terms. Prices may vary by region and include or be subject to taxes as displayed. RevenueCat assists in verifying subscription entitlements; Apple processes App Store payments.

Subscriptions renew unless canceled through Apple before the applicable renewal deadline. To avoid a renewal or conversion charge, cancel at least 24 hours before the end of the current subscription or trial period. Eligibility for introductory offers is determined by the applicable offer and Apple account rules; a trial is not available to every user. Unless canceled, an eligible trial converts to the paid subscription disclosed when accepted.

You may manage or cancel a subscription in your Apple account subscription settings. Uninstalling the App, deleting your Whisk account, or ceasing use does not cancel billing. Cancellation ordinarily prevents future renewal; the remaining access period is determined by Apple and the applicable offer. Trial access may end when canceled.

When a subscription or trial expires, access to Pro-only catalog recipes and new customization reverts to the applicable free-tier restrictions. You retain access to your previously saved customized recipes through the account that owns them without an active Pro subscription. This access does not include the right to create new customizations or access other Pro-only content, and remains subject to account deletion, lawful account restrictions, and changes permitted under Section 9.

Whisk provides scheduled trial-expiration reminders. Delivery may be affected by notification permissions, device settings, connectivity, and platform delivery conditions. A reminder does not cancel or extend a trial or alter the billing date. You remain responsible for managing cancellation using the dates and terms displayed by Apple. Nothing in this provision excludes a notice obligation or remedy required by applicable law.

Refund requests for App Store purchases are administered by Apple under its applicable procedures. Nothing in these Terms excludes a refund, cancellation, or other remedy required by law. Price or subscription changes are subject to applicable notice and consent requirements.

Subject to these Terms and any applicable Apple license terms, Whisk grants you a limited, personal, nonexclusive license to use the Services for lawful, noncommercial purposes. Whisk and its licensors retain their rights in the software, catalog, images, branding, and other protected materials.

You retain any rights you hold in prompts, board names, custom items, feedback, and other materials you submit. You grant Whisk a nonexclusive license to host, reproduce, process, adapt, and transmit those materials only as reasonably necessary to provide, secure, support, and maintain the Services and fulfill lawful retention obligations. This license permits the processing needed to perform your customization request; it does not make private customizations public.

You must have authority to submit your materials and must not infringe another person’s rights. Any rights you may hold in customized output remain subject to applicable law and the rights in underlying catalog content. No provision grants ownership of third-party content or permission to reproduce the catalog commercially.

You must not use the Services unlawfully; violate another person’s rights; submit malicious code; compromise security; impersonate another person; bypass subscriptions or access controls; scrape or redistribute protected catalog content without authorization; or materially interfere with the Services. Reverse engineering is prohibited only to the extent that such restriction is permitted by applicable law.

You must not submit another person’s sensitive information without lawful authority, use customization to facilitate harmful conduct, or misrepresent generated content as verified professional advice.

Recipes, photographs, dietary labels, and nutrition information are provided for general information and convenience. Nutrition values are estimates and may vary with ingredients, brands, portions, and preparation. Photographs are illustrative and need not depict the precise result of a customized recipe.

Whisk is not a medical, nutritional, or allergy-management service. Preference filters and customization do not certify that food is free of allergens or suitable for any condition. Review ingredient labels, substitutions, cross-contact risks, cooking temperatures, storage conditions, and portion calculations. Consult a qualified professional about individual health or dietary requirements. Do not rely on the Services for emergency advice.

Access depends on compatible devices, internet connectivity, and supporting services. We may maintain, correct, or update features and catalog entries. Temporary outages, delayed image loading, failed customization, or entitlement-verification delays may occur. No uninterrupted or error-free availability is promised.

Material changes affecting a paid service are subject to applicable law, the purchased offer, and any required notice or remedy. This section does not authorize withholding a paid service without any remedy required by law.

You may discontinue use and request account deletion through the App or support@trywhisk.app. Deletion is subject to the Privacy Policy and does not itself cancel an Apple subscription.

We may restrict or terminate access where reasonably necessary to address a material breach, unlawful conduct, security risk, or legal obligation. Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue. Contact support@trywhisk.app to dispute a restriction. Accrued obligations and provisions that by their nature should survive termination remain effective, subject to applicable law.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. EXPRESS COMMITMENTS AND WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED REMAIN UNAFFECTED.

To the extent permitted by law, Whisk is not liable for indirect or consequential loss, lost profits, or loss arising from reliance on inaccurate recipe or AI content. Subject to the exceptions below, Whisk’s aggregate liability arising from the Services will not exceed the greater of US $100 or the amount paid by you to Whisk for the Services during the 12 months preceding the event giving rise to the claim.

These limitations do not exclude or limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where such exclusion is prohibited, or any liability or consumer remedy that cannot lawfully be excluded or limited. Where a limitation is prohibited, it applies only to the extent permitted.

Apple’s applicable license terms govern the App Store license to the App unless a valid custom license has been provided through the App Store. These Terms supplement that license for the Services and do not override mandatory Apple usage rules or applicable law. Apple is not the provider of Whisk’s recipe, planning, or support services.

External services may require separate terms. Whisk remains responsible for its own obligations; reference to a third party does not waive your rights against Whisk. For App support or claims concerning the Services, contact support@trywhisk.app.

These Terms are governed by California law, without regard to conflict-of-law rules, except to the extent mandatory law provides otherwise. If you are a consumer, this choice does not deprive you of the protections of mandatory law in your place of habitual residence or any right to bring proceedings in a court available to you under applicable law.

Please contact support@trywhisk.app to seek an informal resolution of a dispute. Doing so is not a mandatory prerequisite to exercising a statutory right or seeking urgent relief. These Terms do not impose mandatory arbitration or a class-action waiver.

If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision is not a waiver. These Terms, the applicable purchase terms, and the applicable App license comprise the agreement concerning the Services, without limiting rights arising under law.

We may revise these Terms and will identify the effective date of each revision. Material changes will be communicated as required by law, and acceptance will be requested where necessary. Revisions do not retroactively eliminate accrued rights. If you do not accept a revision, you may discontinue use and cancel future renewal, without prejudice to any mandatory remedy.
